1. Purpose and Scope
These General Terms and Conditions of Sale and Use (hereinafter the “CGVU”) are intended to define the rights and obligations of:
- the company Gustoor, operated by SAS Veggie Lille,
- the Users of the platform (customers and partner restaurants).
2. General Terms of Use (GTU)
2.1 Access to the Platform
Use of the platform is reserved for individuals with legal capacity who fully and unreservedly accept these CGVU.
2.2 Legal Compliance
All Users undertake to comply with the applicable regulations (hygiene, food safety, consumer protection law).
2.3 Intellectual Property
All tools, content, trademarks, and processes made available by Gustoor remain the exclusive property of their respective holders.
Any unauthorized reproduction or reuse is prohibited.
2.4 Suspension and Termination
Gustoor may suspend or terminate access to the platform in the event of serious breach, without prior notice.
3. General Terms of Sale – Customers
3.1 Orders
Customers may order meals through the Gustoor platform. Orders are firm and final once payment is confirmed.
3.2 Prices and Payments
Displayed prices include VAT. Payment is processed through secure providers (PCI-DSS compliant).
3.3 Delivery
Delivery times are indicative. Gustoor cannot be held liable for delays attributable to partners or delivery personnel.
3.4 Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to perishable foodstuffs prepared according to the customer’s specifications.
4. General Terms of Sale – Partner Restaurants
4.1 Eligibility and Compliance
The Partner must provide an up-to-date Kbis (business registration extract), health registration, operating license, and professional liability insurance.
4.2 Partner Obligations
- Compliance with recipes and brand standards.
- Preparation of orders within the specified timeframes.
- Maintenance of a customer satisfaction rate above 90% and a rejection rate below 2%.
4.3 Commissions and Payments
- Gustoor collects a commission (as defined in the contract).
- The net balance is transferred to the Partner within 15 days after the end of the month.
- Customer refunds may be offset against future payments.
4.4 Quality Standards and Audits
Audits may be conducted. Any serious breach may result in immediate suspension or termination.
5. Personal Data Protection (GDPR)
Gustoor and its partners undertake to comply with the GDPR.
- Customer data is collected solely for the performance of the contract.
- Any data breach must be reported within 48 hours.
- Customers may exercise their rights (access, rectification, deletion, objection) by writing to support@gustoor.com.
6. Applicable Law and Dispute Resolution
These CGVU are governed by French law.
In the event of a dispute, the parties shall first seek an amicable resolution.
Failing that, the competent courts shall be those within the jurisdiction of the Court of Appeal of Lille.
